From his mouth to God’s ears… The interesting question is… would the democrats vote for this again… or would the SCOTUS vote for this again?
A former federal prosecutor claimed Tuesday that a new case challenging Obamacare in federal court is “a slam dunk” for opponents of the law.
Fred Tecce spoke to Fox News’ Jenna Lee about a lawsuit opening today in Washington, DC. Business owners are suing the government over one small clause in the law, arguing that the wording does not permit poor people in 36 states to obtain government-funded health care and would allow the IRS to saddle small businesses with massive penalties. (RELATED: Obamacare back in court Tuesday).
Lee asked Tecce if the plaintiffs challenging the law had a case. “Do they have a case?” he answered incredulously. “I’m going to tell you something. Before, as Dr. Krauthammer said, this ‘lawlessness’ began, this case would be a slam dunk.”
“It’s very simple,” he explained. “When you talk about interpreting a statute, Jenna, the words of the statute control. And the words of the statute define this exchange as set up by a state and they authorize subsidies for exchanges as defined by the statute. And — this is the irony of this — the law presumes that Congress knew what they were doing when they passed a statute. That’s the end of the conversation.”
Teece also pushed back against the government’s — and his fellow panelist Doug Burns’ — argument that the issue is simply “a mistake” and that the court should interpret what Congress meant, not what they wrote.
“When they wrote the section of the law that indicated who was going to get the subsidies, they specifically did not include the federal exchanges,” he said. “At the end of the day, even if it was a mistake — a typo, as my learned colleague is trying to say — it’s too bad, because mistakes are drawn against the drafters. . . If that’s what they meant, then that’s what they should have said.”
“This is what happens when you ram a bill through with no back-and-forth, no bipartisan support,” he later added. “Ultimately, because of the mistakes that were made, the irony is that the real, the legitimate, the lawful fix for this would be to send the law back to Congress and tell them to fix it.”
Nothing to see here… Just as the democrats… But I thought is was because of a half assed protest because of a movie??
Why weren’t things blowing up the day after. This isn’t just an “American”… this was a premeditated attack and murder of a US Embassidor. This is paramount to attacking the USA on our soil. Yet obama hits the snooze button and hillary doesn’t think it matters. Just so disgusting.

The terrorists who attacked the Benghazi consulate last year knew the location of the safe room where Ambassador Chris Stevens and his security team sought shelter, according to a congressman who spoke for 90 minutes with the diplomatic security agent severely injured in the assault.
“He confirmed this – that it was a very well orchestrated, and well organized, almost a military operation, using military weapons and using military signals,” the late Florida Rep. Bill Young said after meeting diplomatic security agent David Ubben at Walter Reed Medical Center last summer, when both were patients there.
“He (Ubben) emphasized the fact that it was a very, very military type of operation they had knowledge of almost everything in the compound,” Young explained. “They knew where the gasoline was, they knew where the generators were, they knew where the safe room was, they knew more than they should have about that compound.”
[B]An August 16 classified cable, reviewed and reported on by Fox News last fall, showed there was an emergency meeting in Benghazi less than a month before the attack due to rapidly deteriorating security. The cable warned the office of Secretary of State Hillary Clinton, and other State Department leaders in Washington, that the consulate could not sustain a coordinated assault.
The cable also reflected a grave concern among officials on the ground that the Libyan militia charged with protecting the consulate had been compromised, perhaps even infiltrated by extremists.[/B]

Yesterday, the President of the United States addressed the nation and said he would use “enforcement discretion” on a major piece of legislation.
THERE IS NO SUCH AUTHORITY GRANTED TO HIM IN THE CONSTITUTION
He has done this in the past with ILLEGAL immigration, the employer mandate, even how he elected to enforce the closing of national parks during the shutdown.
He has no legal authority to do that. Right now the President is acting outside of the law. Intentions of actions are inconsequential here. The abuse of power this represents if frightening.
All he said yesterday was he would ignore the law for a year. You’re screwed in 12 months when he enforces both the individual and employer mandates. Worse, he has established precedent that he can grant favor and punish you whenever he elects – to hell with the other two branches of government.
Today, he grants you a reprieve. What if tomorrow Caesar does not? What if the thumb turns down tomorrow and you have sat idly by why the rule of law designed to protect you was dismantled.
It never ceases to amaze me how willing liberals are to turn over control of their life to a charismatic tyrant. History is filled with such examples… Ask those people how it worked out for them.
He is either unwilling or unable. He either knew and is lying. Or didn’t know and is irresponsible. Take your pick liberals.
He knows everything. And yet he seems to know nothing. He’s passionate about the details of domestic policy but wasn’t privy to the details of his own legacy law. He’s an academic with a command of every issue at once but seemingly only finds out what his administration is doing in news reports. He’s so brilliant every normal endeavor he’s tried has bored him, but he couldn’t bother to entertain himself with more than one monthly meeting on the make-or-break program of his presidency. He’s the captain of the Culture of Competency who has overseen the most incompetent rollout of an entitlement program in history.
The animating feature of Obama’s leadership style is simply making pronouncements. Making them about things he knows, things he knows not, and waiting for everyone and everything to fall in line. And, when things don’t magically come together, he pronounces his disappointment and anger. Wash, rinse, repeat.
After years preparing for the crash landing the president ordained, Obama said to call it off because his initial decision had proven politically untenable. So never mind. Now it’s up to others to try to clean it up, and to take the blame when they cannot…
After seven weeks of deepening anxieties and growing anger – seven weeks in which the president was forced to apologize for deceiving voters in the last election, seven weeks in which Americans came to mistrust their president – the solution offered was to codify the administration talking points blaming insurance companies and state officials. And then, after talking about how he was going “to keep on working as hard as [he] can” to “win back some credibility on this health care law,” he headed to Philadelphia for a fundraiser.
This incredibly potent version of the Incompetence Defense – that unique Obama Administration tactic of claiming you should not be fired because you’re not very good at your job – was followed by the President’s assurances that now he’s going to start “asking a lot of questions.”
He’s not just making himself look foolish with these naughty-toddler excuses, he’s discrediting the entire theory of superior government planning. He’s telling you that his trillion-dollar apparatus is incapable of managing itself. Everyone lies to everyone else. Managers are kept in the dark, all the way through a half-dozen levels of redundant bureaucratic management. The President who seized control of health insurance could not be bothered to spend a single hour finding out how the project was going before it launched, crashed, and wreaked havoc. At one point during Thursday’s presser, Obama mused aloud that government procurement is always wasteful and inefficient. Now he tells us!…
The monarch of managerial liberalism just spent an hour explaining that Big Government cannot be trusted to manage things, and cannot be held accountable when it fails. Obama made a fool of himself today, and a mockery of his own governing philosophy. Republicans would be equally foolish to throw him a lifeline by keeping any “fix” proposals on the table. Full repeal should be the price of Democrat political survival. A lot of them are, or soon will be, frightened enough to accept.
Obamacare is collapsing in on itself. The second the shutdown ends Obama will push for immigration reform. Right after that, he will issue a one year delay in the individual mandate. He won’t have a choice. And it will be illegal because he will simply elect to NOT ENFORCE THE LAW OF THE LAND which is ironic and infuriating beyond words. He could do it legally, but that would give the Tea Party a win and that just can’t be allowed.
The math is simply on this one. He needs healthy people on the exchange to subsidize the unhealthy. If it is out of balance, rates go up and this gets worse. If no one is on it, rates go up for nothing. No one is on it right now. Further, he can’t tax someone for something they were unable to access. Well, he could but even he isn’t that stupid. Can you imagine the outrage when the “Shared Responsibility Payments” hit tax returns this year – and enrollment is at fractions of projections? My guess is had the launch gone perfectly this would be a done deal. But because it is such a disaster and there is sticker shock, he will have no choice but to ILLEGALLY delay everything for a year to get the Democrats through the mid-terms. Oh, he will have Occupy for America try and sign up as many people as possible, but in the end he is going to be forced to delay the individual mandate.
